FLEXIWRITETM END USER LICENCE AGREEMENT (EULA)
In this document ‘You’ and ‘Your’ shall refer to the person downloading
and/or installing and/or using FlexiWriteTM. ‘We’, ’Us’ and ‘Our’
shall refer to Samuel Green, or such entity as takes on Samuel Green’s
interest in FlexiWriteTM with his permission. FlexiWrite and
FlexiWriteTM shall refer to the software application. Where FlexiWrite
and FlexiWriteTM are used to refer to Samuel Green and his employees and
agents concerned with the business of developing, promoting, and
distributing FlexiWriteTM (the application), this will be made clear in the
By installing and/or using FlexiWriteTM you agree to the terms of this
EULA. If you do not agree to these terms, you must stop using
FlexiWriteTM and remove all copies of it from your device. We reserve
the right to withdraw your right to use FlexiWriteTM should you breach any
of the terms contained in this EULA. In such circumstances you must
stop using FlexiWriteTM immediately and remove all copies of it from your
FlexiWriteTM is licensed, not sold, under the terms of this agreement.
We retain all intellectual property rights to FlexiWriteTM, including but
not limited to Copyright of the source code, title, and trademarks.
Installed versions of FlexiWriteTM:
You are granted the non-exclusive, non-transferable right to install and use
one copy of FlexiWriteTM on one device. FlexiWriteTM may be used by
more than one individual on that device, providing each individual has
access to this EULA. Each user’s use of FlexiWriteTM shall be in
accordance with the terms of this EULA.
Non-install versions of FlexiWriteTM, or where FlexiWriteTM is used without
permanently installing it on a single device (collectively non-installed

You may not modify, edit, copy portions of, or attempt to reverse engineer
or access the source code of FlexiWriteTM. You may not make available
for download or otherwise re-distribute FlexiWriteTM to the public.
You may provide individual copies of FlexiWriteTM to other individuals, or
copy FlexiWriteTM to additional devices which you own, only in the following
limited circumstances: 1) The device on which FlexiWriteTM is to be
installed does not connect to the internet or; 2) The device on which
FlexiWriteTM is to be installed connects to the internet but it would be
prohibitively expensive or time consuming to download FlexiWriteTM onto the
device owing to the nature of the device’s internet connection or; 3)
It is not possible to download FlexiWriteTM onto the device owing to
temporary network problems, problems with our servers or those of our
agents, or for other technical reasons. In all other circumstances an
additional copy of FlexiWriteTM must be obtained from us or our
agents. When providing copies of FlexiWriteTM to individuals under the
terms above, you may not represent yourself as the developer of FlexiWriteTM
or our agents, and you may not represent FlexiWriteTM as your work; you must
only provide the complete, unmodified package with its original filename,
for example flexiwrite-eng-mac.dmg or flexiwrite-eng-win.zip. You may
not provide copies of FlexiWriteTM without this EULA. You may not
provide copies of FlexiWriteTM along with other software in a manner that
may lead to confusion or uncertainty about which features are included with
FlexiWriteTM and which with that other software; for example but not limited
to providing an installer program that installs FlexiWriteTM along with
other software. You may not charge a fee for providing copies of
FlexiWriteTM. You may create one or more backup copies of FlexiWriteTM
for installing on the same device(s) for which it was downloaded. If
you are provided with a non-release version of FlexiWriteTM, e.g. by email,
this is to be treated as confidential. You must not redistribute,
provide copies of, or advertise a non-release version of FlexiWriteTM under
any circumstances. All other terms in this EULA also apply to
You may not install and run multiple copies of FlexiWriteTM on a single
device for the purpose of viewing or editing more than one document at any
given time. You may not attempt to run multiple instances of
FlexiWriteTM for the purpose of viewing or editing more than one document on
a single device at any given time, except by obtaining a valid Pro licence
key from us or our agents with our consent.
Certain features and functionality are available only as part of the 'Pro'
package of features within FlexiWriteTM. See
https://www.flexiwrite.com/english/what's-new.html for a list of features
that are included with FlexiWriteTM as standard, and those that are part of
FlexiWriteTM Pro. You may not attempt to access or use the 'Pro'
features without a valid Pro licence key obtained from us or our agents with
our consent. This will normally require payment of money. You
may only use a Pro licence key with one copy of FlexiWriteTM installed on a
single device, or with one non-installed copy of FlexiWriteTM used on no
more than one device at any given time. A Pro licence key may be used
by more than one individual on a single device on which FlexiWriteTM is
installed. A Pro licence key may be used with a single non-installed
copy of FlexiWriteTM by more than one individual, providing that the
licensee (i.e. the person who downloaded the licence key) is present.
Under no circumstances may a single Pro licence key be used on more than one
device at any given time. Where FlexiWriteTM Pro features are required
on more than one device at any given time, additional Pro licence keys must
be obtained. You may not make available for download or otherwise
re-distribute or provide copies of FlexiWriteTM Pro licence keys under any
circumstances. FlexiWriteTM Pro licence keys are normally intended to
be valid only for the current version and minor updates, typically with bug
fixes but no new features. So for example a licence key obtained for
version 01-03-00 will be valid for version 01-03-01, 01-03-02 etc. (if
released) but not 01-04-00 (if released) for which a new licence key would
be required. You may not attempt to alter licence keys to extend their
validity beyond the intended versions.
Where webpages are exported from FlexiWriteTM, the respective document
author(s) or other copyright holders retain copyright over the material they
created using FlexiWriteTM. However, we retain copyright and all other
intellectual property rights over those parts of the webpages that are
included with, or created by FlexiWriteTM, such as layout templates and
formatting templates. You may not remove links to flexiwrite.com or
other information about FlexiWriteTM from webpages exported from
FlexiWriteTM. When publishing webpages exported by FlexiWriteTM, you
must include all pages including those providing information about
FlexiWriteTM and links to flexiwrite.com or other information about
FlexiWriteTM. You may not alter webpages or folders of webpages
exported from FlexiWriteTM, except for your own content or content for which
you own the copyright.
Various links are provided for webpages, downloads, and email addresses
within FlexiWriteTM. You may not use these links and the associated
services in any manner that may inconvenience other users, or damage,
disable or overburden the services.
FlexiWriteTM is provided without warrantee. We do not warrant that
FlexiWriteTM will be, or will remain, fit for any particular purpose.
Under no circumstances shall we be liable for any damages or consequential
damages arising from your use of FlexiWriteTM, including but not limited to
data loss or inability to access data.
If we release or otherwise provide updates or updated versions of
FlexiWriteTM, this EULA shall also apply to the updates or updated versions,
unless the updates or updated versions are provided with their own
EULA. Under such circumstances the new EULA shall supersede this EULA
for the update, the updated version, or if stated in that EULA the updated
copy of FlexiWriteTM on your device.
Some versions of FlexiWriteTM are provided with the Java Runtime Environment
(JRE). Use of these versions is also subject to the Oracle Binary Code
Licence Agreement (BCL). Intellectual property rights to the Java
Runtime Environment are held by Oracle. Samuel Green and his employees
and agents do not develop, maintain, or make any claim to intellectual
property rights to the JRE.
